T. A. Cavanaugh defends double-effect reasoning (DER), also known as the principle of double effect. DER plays a role in anti-consequentialist ethics (such as deontology), in hard cases in which one cannot realize a good without also causing a foreseen, but not intended, bad effect (for example, killing non-combatants when bombing a military target). This study is the first book-length account of the history and issues surrounding this controversial approach to hard cases. It will be indispensable in theoretical ethics, applied (...) ethics (especially medical and military), and moral theology. It will also interest legal and public policy scholars. (shrink)

Kant's readers have disagreed about whether, according to his account of cognition, concepts, representations of the understanding, are involved in intuitions, representations of sensibility. But proponents of the affirmative 'conceptualist' answer and those of the negative 'non-conceptualist' answer have alike presupposed that such involvement should be construed in a particular way: i.e., as the involvement of particular concepts in particular exercises of sensibility. I argue, on the contrary, that it should not be: that though, for Kant, no concepts are applied (...) in exercises of sensibility, nonetheless the understanding, the faculty of concepts, is teleologically internal to sensibility and, therefore, to its exercises. That is, those exercises are per se directed towards the provision to the understanding of objects to which its fundamental concepts, the categories, are applicable, though no act of categorical application is internal to them. This conception of sensibility, available only in light of a careful distinction between capacities and acts, is demanded, I argue, by Kant's conception of a priori knowledge as elaborated in his Transcendental Deduction. In early major works, Cassirer and Schlick differently recast traditional doctrines of the concept and of the relation of concept to intuitive content along the lines of recent epistemological discussions within the exact sciences. In this, they attempted to refashion epistemology by incorporating as its basic principle the notion of functional coordination, the theoretical sciences' own methodological tool for dispensing with the imprecise and unreliable guide of intuitive evidence. Examining their respective reconstructions of the theory of knowledge provides an axis (...) of comparison along which to locate Cassirer's Neo-Kantianism and Schlick's pre-positivist empiricism, and an immediate background of contrast to the subsequent rise of logical empiricism. For in the absence of intuition all our knowledge is without objects and therefore remains entirely empty. Most of the issues in the philosophy of mind were formulated long before Charles Darwin produced a scientific theory of biological evolution. That theory had an immediate impact on issues in many areas. But on the philosophy of mind its impact was delayed, and discussions continued for some time as though Darwin had never existed. Even today this is largely true. Yet a theory whose consequences are so far-reaching, and which has radically altered ideas about living things, was bound, sooner (...) or later, to affect discussions of mental phenomena. The pragmatists were the first group of philosophers to work out in detail a philosophy of mind based on evolutionary principles. Moreover, since they were familiar with classical ideas in the field, they were able to assess the kinds of changes in those ideas which evolutionary principles required. My aim in this paper is to review the main features of their enterprise, and to offer some assessment of it. (shrink)

T. A. Cavanaugh's Hippocrates' Oath and Asclepius' Snake: The Birth of the Medical Profession articulates the Oath as establishing the medical profession's unique internal medical ethic - in its most basic and least controvertible form, this ethic mandates that physicians help and not harm the sick. Relying on Greek myth, drama, and medical experience (e.g., homeopathy), the book shows how this medical ethic arose from reflection on the most vexing medical-ethical problem -- injury caused by a physician -- and argues (...) that deliberate iatrogenic harm, especially the harm of a doctor choosing to kill (physician assisted suicide, euthanasia, abortion, and involvement in capital punishment), amounts to an abandonment of medicine as an exclusively therapeutic profession. The book argues that medicine as a profession necessarily involves stating before others what one stands for: the good one seeks and the bad one seeks to avoid on behalf of the sick, and rejects the view that medicine is purely a technique lacking its own unique internal ethic. It concludes noting that medical promising (as found in the White Coat Ceremony through which U. S. medical students matriculate) implicates medical autonomy which in turn merits respect, including honoring professional conscientious objections. (shrink)

Professional identity and competent ethical behaviors of nursing students are commonly developed through curricular inclusion of professional nursing values education. Despite the enactment of this approach, nursing students continue to express difficulty in managing ethical conflicts encountered in their practice. This descriptive correlational study explores the relationships between professional nursing values, self-esteem, and ethical decision making among senior baccalaureate nursing students. A convenience sample of 47 senior nursing students from the United States were surveyed for their level of internalized professional (...) nursing values (Revised Professional Nursing Values Scale), level of self-esteem (Rosenberg’s Self-Esteem Scale), and perceived level of confidence in ethical decision making. A significant positive relationship (p < 0.05) was found between nursing students’ professional nursing values and levels of self-esteem. The results of this study can be useful to nursing educators whose efforts are focused on promoting professional identity development and competent ethical behaviors of future nurses. (shrink)

The purpose of this article is to re-examine the more important extant manuscripts of Livy 21–25 with special reference to omissions and significant errors, and on this basis to try to establish their interrelationship in stemmatic form. A stemma for Books 26–30 has already been drawn up by Professor S. K. Johnson in O.C.T. vol. iv, but, since the tradition for those five books is slightly different from that of the first half of the third decade, it has seemed worth (...) while to draw up a stemma for Books 21–25 independently. The purpose of this article is to set down the results of a careful examination of certain readings contained in Books 21–25 of the Codex Agennensis of Livy , to consider the significance of these readings in the textual tradition of Livy 21–25, and to discuss briefly a point raised by Professor G. Billanovich in his recent article on the Agennensis.

Exgesis on Mīmāṃsābhāṣya, Śabarasvāmi's commentary on Jaiminī's Mīmāṃsāsūtra, basic aphoristic work of the Mīmāṃsā school in Hindu philosophy; includes supercommentaries.

The author, a cardiac surgeon specialising in heart transplantation, argues that excellence in medicine must always be pursued and confronts the problems of specialties and super-specialties with widely varying costs and benefit in which the pursuit of excellence results. He advocates that decisions on resource allocation should be the responsibility of the Department of Health and Social Security, acting on the advice of the public's elected representatives on the one hand and the medical profession on the other. The profession has (...) an ever-increasing responsibility to ensure that its advice is soundly based on rigorous self-audit, which should include considering the costs and benefit of its work. His commentator, Lady McCarthy, until recently chairman of an area health authority, responds by arguing that the tripartite system for resource allocation does not work. Doctors resent the imposition of any priorities other than their own. Their two-dimensional medical ethics, concerning doctors' obligations to individual patients, must be supplemented by concern for society as a whole. Biologists have recently found it useful to give a prominent place in their theories to the concept of a plant or animal population. Genetics, ecology, paleontology, and especially the theory of evolution have been able to make notable advances as a result of employing the concept in their interpretations and inferences. The concept has not, however, first been rigorously defined and then put to work. That is rarely the way fruitful scientific notions develop. On the contrary, in most discussions the (...) term “population” has a large degree of vagueness about it. This is due in part to the fact that the term has been taken over from ordinary language and employed in a number of novel contexts. But some of the vagueness also seems to be an unavoidable consequence of the immensely intricate phenomena to which the term refers. In any case, the role played by the concept of a population in evolutionary theory makes even a brief inquiry into its meaning worthwhile. The present paper is concerned with such an inquiry. What I wish to do is, first, to review the major ways in which the concept has been used by biologists in connection with recent formulations of the theory of evolution; and secondly, to comment on a few misleading issues which may arise if care is not taken to observe certain logical and linguistic distinctions. The publication in 1957 of the Wolfenden Report occasioned a celebrated controversy in which profound theoretical issues concerning the relation between law and morality, and the legal enforcement of morality were discussed. The principal disputants were Lord Justice Devlin and Professor H. L. A. Hart. It is by now well known that the main recommendation of the Wolfenden Report was the reform of the criminal law so that homosexual behaviour in private between consenting male adults should no longer be a (...) criminal offence. As homosexual behaviour in Christendom was at the outset punishable in the ecclesiastical courts, and subsequently, with the demise of the ecclesiastical courts, in the secular courts, the Wolfenden recommendation on homosexuality marked a major departure from the prevailing state of affairs in which the precepts of Christian morality, especially relating to sexual morals, were at first enforced by the ecclesiastical courts, and then by the secular courts. In this article I propose to discuss some recent theological contributions to the problem of the historicity of the Gospels, and I wish to suggest that philosophical issues may ultimately be relevant to its solution.
